We may update this Privacy Statement from time to time, as detailed below. You should not use the Site if you have any objections to our Privacy Statement, which is binding upon all users of the Site. Note that this Privacy Statement does not override any specific contracts agreed to by the parties and relationships may be governed by further privacy agreements and pertains specifically to use of the Site. NOTICE AT COLLECTION

We may collect or process various categories of personal information. The sections titled “Personal Information We Collect and Use,” “Notice to California Job Applicants,” and “Notice to California Businesses And Service Providers With Whom We Have Business Relationshipscontains information on the categories of Personal Information collected and our disclosure practices. As an overview, we collect identifiers; commercial information; sensitive personal information; employment information; internet, technical or other similar network activity information; and inferences drawn from other information. We collect, use, and disclose personal information for the following business purposes: to fulfil or meet the reason you provided the information; to contact you in relation to our Site; to provide personalized communications; to respond to an inquiry; to maintain contractual relationships with our customers, vendors, and business partners; to undertake activities to verify or maintain customer accounts; to perform services on behalf of Emerald EMS such as payroll, sales, transaction processing, and purchasing; or to screen for potential risk or fraud. We retain all personal information for as long as needed to fulfill the purpose for which it is collected and to comply with our legal obligations, resolve disputes, and enforce our agreements.

The types of information we collect when you use the Site depend on the features you use on the Site. “Personal information” is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Emerald EMS collects, stores, and processes personal information concerning its potential, current, and former customers, suppliers, vendors, business partners, stockholders, visitors to the Site, facilities, marketing booths and events, job applicants, and independent contractors.

These are sourced directly from you (e.g., when you contact us through the Site), indirectly from you (e.g and publicly available sources), or from our business partners.   • Personal information categories contained in consumer records, which may include payment information. We may collect this information directly from you when you order services. Personal information categories contained in consumer records is collected, used, and disclose for the commercial purpose of providing advertising and marketing. We do not sell or share this information. We disclose this information for the business purposes and commercial purpose listed herein to affiliates, internet service providers, administrative service providers, and other third party business partners.
  • Sensitive personal information, which may include health information such as the health conditions of individuals who visit our facilities, including body temperature checks and/or illness symptoms. This is collected directly from you when you visit our facilities. We collect and use this information for the business purpose of protecting health and safety at our workplace. We do not sell or share this information. We may disclose this information for the business purpose listed herein to administrative service providers, payment processors or affiliates. We only collect Sensitive Personal Information to fulfill or meet the reason you provided the information and other business purposes aside from inferring characteristics about a consumer. Therefore, we do not offer a specific right to limit. Please note we collect additional categories of sensitive personal information from job applicants. See our “Notice to California Job Applicants” section for additional information.
  • Employment Information, which may include former and current employer information and job title. Employment information is sourced directly from you (e.g., when you contact us through the Site) or indirectly from you (e.g., from observing your actions on the Site). This information is collected, used, and disclosed for the following business purposes: to fulfil or meet the reason you provided the information; to contact you in relation to our Site; to provide personalized communications; to respond to an inquiry; to maintain contractual relationships with our customers, vendors, and business partners; or to screen for potential risk or fraud. You have choices about the information we collect. Your decision to provide any personal information is voluntary. However, please note that, if you do not provide certain personal information, we may not be able to accomplish some purposes outlined in this Privacy Statement and you may not be able to use or access certain services on our Site.

RECORD RETENTION

We will retain all the information listed in the “Personal Information We Collect and Use” and all information in the “Notice to California Job Applicants” for as long as needed to fulfill the purpose for which it is collected and to comply with our legal obligations, resolve disputes, and enforce our agreements.

COOKIES, ONLINE TRACKING, AND ADS

Like many other Sites, we use “cookies,” which are files stored on your computer’s hard drive by your browser. We use cookies to collect information such as the server you are logged onto, the domain name of your internet service provider, your browser type and version and your IP address. We may also derive the general geographic area associated with an IP address.

Such parties may manage our customer information and perform services on our behalf, such as website hosting, fraud monitoring, email or mail delivery and administration, or data analysis, etc. We ask affiliates with whom we disclose your information to confirm that their privacy practices are consistent with ours and applicable law, and we provide them with only the information they need to perform their services for us.
  • We may disclose your information with third parties including our agents, service providers, and consultants as needed for them to provide business-related services to us. Such third parties may manage our customer information and perform services on our behalf, such as website hosting, fraud monitoring, email or mail delivery and administration, or data analysis, etc. We ask third parties with whom we disclose your information to confirm that their privacy practices are consistent with ours and applicable law, and we provide them with only the information they need to perform their services for us.
  • We may disclose your information or combine your information with publicly available information when we team up with promotional partners to jointly offer or provide services, contests, or promotions to our customers, or otherwise to enhance and personalize your experience.

HOW WE RESPOND TO DO NOT TRACK SIGNALS

The “Do Not Track” (“DNT”) privacy preference is an option that may be made in some web browsers allowing you to opt-out of tracking by websites and online services. At this time, global standard DNT technology is not yet finalized and not all browsers support DNT. We therefore do not recognize DNT signals and do not respond to them.

SECURITY

We take reasonable physical, electronic and managerial measures to safeguard and secure any personal information you provide to us. Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Site or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Site. We may post a notice via our Site if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

CONSENT TO TRANSFER

If you are visiting our Site from a location outside of the U.S., your connection may be through and to servers located in the U.S. Any information you provide during your visit will be processed and maintained on our server and other internal systems located within the U.S. You acknowledge you understand that by providing your personal information to us, your personal information (i) will be used for the uses identified above in accordance with this Privacy Statement, and (ii) may be transferred to the U.S. as indicated above, in accordance with applicable law. For example, where personal information is transferred from the European Economic Area or United Kingdom to areas which have not been determined to have an adequate level of protection, we take measures designed to transfer the information in accordance with lawful requirements, such as standard contractual clauses or an approved international data transfer agreement, which may be obtained by reaching out to us via the information listed in the “Contact Us” section below.

COLLECTION AND USE OF INFORMATION FROM CHILDREN UNDER THE AGE OF 18

The Site is not intended for use by persons under the age of 18. We do not knowingly collect information from visitors under the age of 18 and, if we learn that a person under the age of 18 has provided us with personal information, we will delete such personal information.

YOUR CALIFORNIA PRIVACY RIGHTS

California consumers, including job applicants and our business clients, have the following rights. To the extent that these rights apply to you, the following rights are provided:

  • Right to know/ data portability: You have the right to know and request information about the categories and specific pieces of personal information we have collected about you, as well as the categories of sources from which such information is collected, the business or commercial purposes for collecting such information, the categories of third parties with whom we disclose such information, and the business and commercial purposes for our disclosure practices. You also have the right to know if we have sold or shared your personal information. However, Emerald EMS does not sell or share personal information. You may also request a copy of the personal information we have collected and, upon request, we will provide this information to you in electronic form.
  • Right to delete: You have the right to request the deletion of your personal information, subject to certain exceptions and our record retention policy.
  • Right to opt-out of sale and sharing: You have the right to opt out of the sale/sharing of your personal information to third parties. However, we do not sell or share your personal information at this time.
  • Right to correct: You may have the right to correct your personal information if inaccurate.
  • Right to limit the use and disclosure of your sensitive personal information: We only collect sensitive personal information to fulfill or meet the reason you provided the information, for hiring purposes, and other business purposes that do not include inferring characteristics about a consumer or job applicant. Therefore, we do not offer a specific right to limit. If you exercise your right to delete sensitive personal information from our systems, it may limit our ability to provide services where such information is necessary and will be subject to the limitations referenced in the “Right to delete” above.
  • Right to opt out of profiling: You have the right not to be subject to a decision based solely on profiling, except under certain exceptions under local law. Emerald does not engage in profiling.
  • Right to non-discrimination: You have the right to not be discriminated against for exercising any of these rights. If you would like to exercise one or more of the rights above, please contact us using the contact information provided below. You may designate an authorized agent to make a request on your behalf. Such authorized agent must be registered with the California Secretary of State. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf.

We may need to confirm your verifiable consumer request before completing your request, and, for example, may ask for you to confirm data points we already have about you. We will only use personal information provided in a consumer request to verify the requestor’s identity or authority to make the request.

NOTICE TO CALIFORNIA JOB APPLICANTS

When you apply for a position with us, we will process your personal information as described in this Privacy Statement, and also as described below as it relates to you as a job applicant.

When you apply for a job with us, we ask you to provide personal information to evaluate your application. All information is provided on a voluntarily basis and you choose what personal information to provide. Please note, if you choose not to provide requested personal information, our ability to consider you for a position may be limited.

We may also get information about you from public sources or third parties. For example, to verify information in your application or conduct background screenings, as allowed by law. If you choose, you may provide us with personal information on third party sites. If you choose to authorize us to access this personal information, you agree that we may collect, store, and use this information in accordance with this Privacy Statement.

How We Use Your Personal Information As A Job Applicant.

We will use your personal information to process your application, including for the below purposes:

  • Recruitment, evaluation and selection of job candidates
  • General, human resources administration and management
  • Conducting satisfaction surveys (for example, to manage and improve the recruitment process)
  • Verifying your employment reference(s), conducting background checks, and related assessments

 Your personal information is not sold or shared. Your personal information will only be disclosed with: Emerald EMS employees with a legitimate business need; third parties specific to job applicants, such as recruitment agencies, consultants, background service providers and attorneys. These entities may change over time. We always seek to ensure that third parties handling personal information do so in a manner consistent with this Privacy Statement and in accordance with the law.
